Indonesia 2026 Workforce Compliance: Wages, Overtime & Data Rules

Indonesia’s 2026 provincial minimum wages took effect on 1 January under Government Regulation (PP) No. 49/2025, while the 2026 national holiday schedule and the Personal Data Protection (PDP) Law continue to shape payroll, scheduling and cross-border HR-data controls. For employers with factories, stores, service sites or regional teams, the practical requirement is a single control framework that preserves each province’s legal settings.

Indonesia is Southeast Asia’s largest labour market and a major location for manufacturing, resources, retail and digital operations. Its workforce rules are national in principle but highly local in execution: provinces and regencies issue wage decisions, religious holidays affect capacity planning, and employee data may move between sites, vendors and regional headquarters.

1. Minimum wage: model province and regency rules separately

Indonesia does not have one nationwide monthly minimum wage. Governors set the provincial minimum wage (UMP); regents and mayors may set a higher regency/city minimum (UMK) where the statutory conditions are met. PP No. 49/2025 amended the wage framework in PP No. 36/2021 and is the legal basis for 2026 adjustments.

The examples below are 2026 UMP figures reported in official provincial decisions and consolidated by the Indonesian legal database. They are not a substitute for checking the UMK applicable to a specific site.

Use IDR as the system-of-record currency. Exchange-rate conversions age quickly and can distract from the legal question: which wage floor applies to this employee, at this location, on this effective date? 2. Public holidays and collective leave

The 2026 Three-Minister Joint Decree (SKB) sets 17 national public holidays and 8 collective-leave days. Public holidays are not the same as *cuti bersama*: collective leave is an administrative scheduling arrangement, and private employers should state in their workplace rules whether it is deducted from annual leave or treated as an additional company benefit.

The SKB does not create an automatic “weekend carry-over” rule for every holiday. Check the annual decree and any local or company announcement before promising a substitute day. Link your holiday calendar to shift bids, minimum staffing, holiday-pay rules and transport plans rather than maintaining a separate spreadsheet.

3. Leave and social-insurance interfaces

The wage treatment of maternity and sickness leave is not a simple “paid/unpaid” switch. It can involve employer payroll, BPJS Ketenagakerjaan/health benefits, medical certification and a protected-employment process. Have local counsel or payroll advisers confirm the interaction for each worker category.

4. Working time and overtime

The standard maximum is 40 hours per week: 8 hours a day over five days or 7 hours a day over six days. Under PP No. 35/2021, overtime generally requires the employee’s written consent and is limited to 4 hours per day and 18 hours per week. A collective agreement or employment contract may set more favourable terms.

Worked example (ordinary day). If the statutory hourly wage is IDR 25,000 and an employee works two overtime hours on a normal workday, the premium is IDR 25,000 × 1.5 + IDR 25,000 × 2 = IDR 87,500. This example excludes regular scheduled wages and assumes both hours are legally payable overtime. Holiday work, wage components, rounding and excluded job categories can change the result.

For frontline operations, the risk is usually a data-chain failure: a supervisor approves a shift in one system, attendance is captured in another, and payroll receives an unlabelled total. 5. Employee data and cross-border transfers

Indonesia’s principal privacy statute is Law No. 27/2022 on Personal Data Protection (PDP Law). The two-year transition period ended on 17 October 2024; employers should therefore treat the law as an operating requirement, not a future project. Implementing regulations and the final institutional arrangements remain important to monitor as of this update.

For a controller sending Indonesian employee data to a regional headquarters, cloud provider or payroll vendor outside Indonesia, Article 56 provides a sequence of safeguards:

  1. confirm that the receiving country has a level of personal-data protection equal to or higher than Indonesia’s;
  2. if not, put adequate and binding safeguards in place; or
  3. where neither is available, obtain the data subject’s consent after explaining the relevant risks.

The law does not impose a blanket private-sector rule that every employee record must stay in Indonesia. Public-sector systems, regulated industries and “strategic/critical” information may carry additional localisation or sector controls. Financial-services employers should also check OJK requirements before moving payroll, identity or customer-linked workforce data.

A personal-data breach must be notified in writing within 3 × 24 hours (72 hours) to the data subject and the competent authority, with the data involved, timing, cause and remedial action. Because the supervisory architecture and implementing rules can change, maintain a current incident-routing register instead of hard-coding an agency name in a global playbook.

Three recurring control failures

1. One wage table for every site

An enterprise may have a single compensation philosophy, but Indonesia requires location-aware wage floors. Store UMP and UMK by site, effective date and worker category; run a pre-payroll variance report; and retain the governor/regent decisions used for the calculation.

2. Overtime approved after the fact

Backdated approvals make it difficult to prove consent, enforce the 4-hour/18-hour caps or trigger the meal entitlement. Put consent, schedule pattern, attendance, meal provision and payroll output in one auditable flow.

3. “The data is in the cloud, so it is compliant”

Cloud location alone does not establish a lawful transfer. Identify controller/processor roles, document the transfer basis and safeguards, restrict access to the minimum necessary fields, and rehearse the 72-hour incident route with the relevant authority and data subjects.

Frequently Asked Questions

Do all Indonesian sites use the same 2026 minimum wage?

No. UMP is provincial, and a higher UMK may apply to a regency or city. Payroll should resolve the rule from the employee’s actual work location and the latest local decision.

Is six months of maternity leave automatic?

No. Law No. 4/2024 guarantees at least three months and permits additional leave in prescribed medical or special circumstances. Configure an evidence-based approval path rather than granting six months by default.

Can an employer require overtime during a production peak?

Generally, overtime requires written employee consent and remains subject to daily and weekly caps. Check any sector-specific exception and the applicable collective agreement before scheduling.

Must every employee record remain in Indonesia?

No blanket private-sector localisation rule applies under the PDP Law. A lawful transfer still requires the Article 56 safeguards, and public-sector, financial and strategic-data rules may be stricter.

What should payroll test first?

Run a site-by-site wage test, then replay a normal-day and public-holiday overtime case using the correct five- or six-day schedule. Test leave events and a simulated 72-hour breach notification before the next payroll cycle.

Can a global WFM policy replace Indonesian legal review?
